1. Introduction

Hi! Welcome to PlanTheFlow.com. I am an individual creator based in Poland, sharing engineering management tools and materials.

By using this website, purchasing or using my materials, you agree to the terms below. If you do not agree, please do not use the site or products.

Important Legal Notice:

The Seller (Merchant of Record): Our order process is conducted by our online reseller Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. This means that when you buy a product, your legal transaction is with Lemon Squeezy, and it is subject to their Terms and Privacy Policy.
The Creator: I (the website owner) am the licensor of the products and provider of the content. I operate legally as an individual creator in accordance with Article 5 of the Entrepreneurs’ Law Act of 6 March 2018 (Poland), which regulates “unregistered activity” (działalność nieewidencjonowana) for small-scale operations.

2. License Agreement (Paid & Free)

When you buy a digital product or use a free one (e.g., checklist, template, guide, app) from this site, you do not “own” the file. You are granted a single-user license.

You CAN:

Use the product for your personal needs or within your own team/company internal processes.
Modify the templates to fit your specific workflow.
Make copies for backup purposes.

You CANNOT (Prohibited):

No Resale: You cannot resell, redistribute, or sub-license the original or modified files (even the free ones).
No Sharing: You cannot upload the files to public websites, share download links, or give the files to friends/colleagues who haven’t purchased it. If you want to share a free tool, link to my landing page, not the file directly.
No PLR: You cannot claim the intellectual property as your own or sell it as a white-label product.
No Client Deliverables: If you are a consultant/agency, you cannot use these templates as a core deliverable for your clients (where they get a standalone copy). Your client must purchase their own license.
No AI Training: You cannot use my content or code to train AI models (LLMs) without my written permission.

Violation: If you violate this license, your right to use the product is automatically revoked, and you must delete all copies without refund.

3. Refunds (14-Day Guarantee)

I want you to be satisfied. I offer a voluntary 14-day money-back guarantee.

Important Notice for EU/UK Customers:
By downloading digital products, you expressly consent to the immediate delivery of digital content and acknowledge that you lose your statutory 14-day withdrawal right once the download begins.

How to claim: I offer a 14-day money-back guarantee on paid products. If the product doesn’t bring you value, email me for a refund via Lemon Squeezy with your Order ID.
Effect: If you receive a refund, your license is strictly terminated. You must delete all copies of the files. Keeping or using a refunded product is a violation of copyright law.

Data Exchange: By downloading free materials (“Lead Magnets”), you agree to subscribe to my newsletter. You are “paying” with your email address in exchange for the content.
Unsubscribe: You can unsubscribe at any time via the link in the footer of any email.
“AS IS” Availability: Free apps and materials are provided “as is”. I reserve the right to remove them or stop supporting them at any time without notice.

5. Disclaimers (Educational Use Only)

I provide online tools (Apps) and educational materials. Here is the reality of using them:

“AS IS” Basis: The tools are provided “AS IS” without warranties of any kind. I do not guarantee that the tools will work perfectly on your specific system or that they are error-free.

6. Limitation of Liability

I limit my liability to the fullest extent permitted by applicable law, including Polish Civil Code Article 558 § 1. If any portion of this limitation is found unenforceable, the remaining portions shall remain in effect.

Financial Cap: My total liability to you for any claims arising from the use of these products is limited strictly to the amount you paid for the product.
For Free Materials & Apps: My total liability to you for any claims arising from the use of free materials or apps is limited to 0 PLN.
No Consequential Damages: I am not liable for any indirect damages, loss of profits, loss of data, or business interruption arising from the use or inability to use these materials.
B2B Exclusion: If you are buying as a business (przedsiębiorca), statutory warranty rights (rękojmia) are excluded pursuant to Art. 558 § 1 of the Polish Civil Code.

7. Right to Discontinue

As this is a personal project, I reserve the absolute right to:

Modify, suspend, or discontinue the website or any products and materials at any time without notice.
Update these Terms of Service. Continued use of the site after changes implies acceptance.

8. Copyright

All content on PlanTheFlow.com (text, code, designs, apps) is my intellectual property and is protected by copyright laws.

9. Governing Law

These terms are governed by the laws of Poland. In the unlikely event of a legal dispute that cannot be resolved amicably, jurisdiction belongs to the court competent for my place of residence.
